Terms of Service

These Terms of Service ("Terms") govern your use of the Lumi English Academy website and tools ("Lumi", "the Service"), operated by Elistria. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. What Lumi provides

Lumi offers English-language learning materials and practice tools for exams including IELTS, PTE and the Michigan English Test (MET). This includes courses, practice tests, an AI Speaking Coach, an AI Band Checker, and downloadable study materials. Some features are free; others may require an account or a paid subscription.

2. Scores are practice estimates, not official results

Very important: any band score, points score, or feedback generated by Lumi's AI tools is an estimate provided for practice purposes only. It is not an official result and is not affiliated with, endorsed by, or guaranteed to match the scoring of IELTS, Pearson (PTE), Michigan Language Assessment (MET), or any official testing body. We do not guarantee any particular result on a real exam. You use our estimates at your own discretion.

3. Original materials and independence

All courses, passages, questions, and practice tests on Lumi are original works created by us. They are modelled on publicly available exam formats but are not copied from, affiliated with, or endorsed by any test publisher. "IELTS", "PTE", "MET" and related names are the trademarks of their respective owners and are used only to describe the exams our materials help you prepare for.

4. Your account

If you create an account, you are responsible for keeping your login details secure and for all activity under your account. You agree to provide accurate information and to notify us of any unauthorised use.

5. Acceptable use

You agree not to:

use the Service for any unlawful purpose or in violation of these Terms;
copy, resell, or redistribute our materials for commercial purposes without permission;
attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service;
submit content that is unlawful, abusive, or infringes the rights of others.

6. Intellectual property

All content on Lumi, including text, courses, practice materials, graphics and branding, is owned by Elistria or its licensors and is protected by intellectual-property laws. You may use it for your own personal, non-commercial study. You retain ownership of the answers and content you submit, and you grant us a limited licence to process them in order to provide feedback.

7. Third-party services

The Service relies on third-party providers (including Supabase, Anthropic, ElevenLabs, Cloudflare and Formspree). Your use of features powered by these providers is also subject to their respective terms. See our Privacy Policy for details.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that its content or AI feedback will be accurate or complete.

9. Limitation of liability

To the fullest extent permitted by law, Elistria and Lumi will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including any reliance on AI-generated estimates or feedback.

10. Changes to the Service and Terms

We may modify or discontinue any part of the Service at any time, and we may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
